回顾古代中国的判例法制度中国古代除了有人所共知的法典式制定法之外,还有发达的判例法。自西周以来,在有据可查的法制史料中,我们可以不断地发现古代中国的判例法。特别是宋代以来,以皇家的名义编纂判例已蔚然成风。判例法的形成和发展,同封建社会其他法律形式一样,经历几千年的漫长历史发展和演变。(一)产生原因孔颖达在《春秋左传注疏》中指出了成文法的局限:“法之设文有限,民之犯罪无穷,为法立文不能网罗诸罪,民之所犯不必正与法同,自然有允疑之理”。战国时荀子说:“有法者以法行,无法者以类举,听之尽也”。类举之“类”是司法
