根据我国《环境影响评价法》等相关法律规定,应当编制环境影响报告书的项目必须适用公众参与程序,而对于应当编制环境影响报告表的建设项目是否适用公众参与程序则没有明确规定。通过对法规的梳理和对现行环评公众参与制度的检讨,我们发现,应当编制环境影响报告表的建设项目的公众参与存在专门性规范缺失、听证会模式发挥空间有限以及编制过程缺乏公众参与等问题,而这些问题存在的原因在于对受影响公众私益的忽视。鉴于现有的法律规范对应当编制环境影响报告表的建设项目的公众参与基本无保障作用,应拓宽环评公众参与的适用范围,将部分应当编制环境影响报告表的建设项目纳入其中。
According to relevant laws and regulations such as China’s Environmental Impact Assessment Law, public participation procedures must be applied to projects that should prepare environmental impact reports. However, there is no explicit stipulation on whether public participation procedures should be applied to construction projects that should prepare environmental impact statement. Through the review of laws and regulations and the review of the current system of public participation in environmental impact assessment, we found that there is a lack of specialized norms in the public participation in construction projects that should prepare the environmental impact statement, the limited space for public hearing and the lack of public participation in the preparation process , And these problems exist because of neglect of the affected public interest. In view of the fact that the existing laws and regulations have no protective effect on the public participation in construction projects that should prepare environmental impact statement, the scope of application of public participation in environmental assessment should be broadened and some of the construction projects that should prepare the environmental impact statement should be included.
