深夜,王柱和醉酒的陈达驱车至度假村泡温泉,但当时温泉池已经关门。陈达随即给门口值班保安塞了一包烟,保安在二人没有购票的情况下,开门让他们进入了温泉池。在泡温泉约半小时后,王柱发现陈达溺水,便赶忙送到医院急救,但经抢救无效死亡。事后,陈达的家属和温泉经营方就赔偿问题协商不成闹上了法庭。法庭上,温泉经营方代表说,陈达在我们的非营业时间、没购票的情况下泡温泉,因此公司没有义务对他的安全负责。况且作为成年人,陈达在饮酒后泡温泉,本人存在一定过错。陈达父亲则认为,因为温泉经营方的管理漏洞,我儿子才能在非营业时间进入,因此经营方必须承担赔偿义务。
