融资租赁兼具融资和融物的双重功能,已日渐成为企业销售和企业融资的重要手段,在欧美一些经济发达国家融资租赁已经成为大型设备投资中的重要融资手段。融资租赁承租人享有选择租赁设备和供货方的权利、与受领标的物有关的买受人的权利、对租赁设备排他性占有和使用的权利、对租赁设备的留购选择权等一系列权利。但由于其处于相对弱势的地位,应通过对出租人、出卖人等的约束加强对承租人的权利救济。
