一、关于侵害商业秘密的主体问题我国《反不正当竞争法》将侵害商业秘密的主体限定为“经营者”,而一般情况下,经营企业很难直接获取其他企业的商业秘密,多是通过接收其他企业的员工,而获取商业秘密,即商业秘密侵权行为的发生,往往是由于企业员工“跳槽”引起。所以,在司法实践中,受害人会把获取商业秘密的企业连同“跳槽”员工一起作为被告,要求其承担连带侵权责
