《寄簃文存》卷四的基本内容为:考、释、学断。考,即考证,本卷只有一篇,比部考,其性质是关于行政法的历史考证。释,即介绍、阐释,计四篇:释贷借,属于民法范围;释虑囚,属于刑事审判制度,即对犯人的复查制度;释规避,亦属刑法范围（略）;释闸（略）。学断,即分析判断案例,列举论证了四件:后魏刘辉之狱、宋安崇绪之狱、宋檀偕之狱、宋阿云之狱。本卷较前三卷虽然涉及的方面广一些,但主要的仍然是关于刑法方面的论述。 现分别评述如下:
