行政问责制度作为权力监督的重要一环,既可以督促行政机关工作人员依法行政,同时也保护公民的合法权益免受行政权力的侵害。现阶段我国行政问责制度取得了一定成效,但仍存在不少缺陷,在问责的启动主体和问责运行程序等方面还有诸多需要改进的地方。赋予公民提起诉讼的权利,以公民直接利用诉讼的方式启动行政问责是可以考虑的一条新路。
As an important part of the supervision of power, the system of administrative accountability not only can urge the staff of administrative organs to administer according to law, but also protect the legitimate rights and interests of citizens from administrative power. At present, China’s administrative accountability system has achieved some success, but there are still many shortcomings. There are still many areas that need to be improved in terms of the main body of accountability and procedures for accountability. To give citizens the right to initiate a lawsuit, and to start the administrative accountability directly by citizens through litigation is a new way to be considered.
