公平责任原则是能否作为侵权行为法的归责原则之一,一直以来在学术界存在广泛的争论,笔者赞成否定说,即公平责任原则不应该作为侵权行为的归责原则。
The principle of fair liability is one of the principles that can be attributed to tort law. There has been a wide range of controversies in academia. I agree with the negative that the principle of fair responsibility should not be regarded as the principle of tort liability.
