第三方调查是因为政府对公共事件的调查结论难以取信于民而产生的实践创新,契合了弥补政府权威的现实需求,从而展示出制度化讨论的必要性。从正当法律程序的视角出发,考察公开报道的三个案例中的第三方调查的运作,不难发现既有的第三方调查实践存在一系列问题,如启动者中立性不足、调查组独立性欠缺、调查组成员遴选程序不透明、调查报告的效力存疑,等等。
