新闻审判是指新闻媒体及其从业人员利用媒介传播资源,对司法案件审理进行主观式的判断,是影响和妨碍司法公正的不良行为,也是现阶段我国社会主义民主法制建设过程中必须着力解决的问题。司法工作需要社会舆论及新闻媒体的监督,但是新闻司法监督绝不等同于新闻审判。本文从分析新闻审判的基本特点入手,着重研究新闻审判行为出现的原因,同时就如何有效防范新闻审判行为进行了思考。
News trial refers to news media and its practitioners using the media to disseminate resources and judge subjective judgments of judicial cases. It is a bad act that affects and obstructs judicial justice. It is also an issue that must be solved urgently in the process of building socialist democracy and legal system in our country at this stage problem. Judicial work requires the supervision of the public opinion and the news media, but the judicial supervision of the news is by no means the same as the news trial. This article begins with the analysis of the basic features of news trials, focuses on the reasons for the appearance of news trials, and at the same time makes some reflections on how to effectively prevent news trials.
