行政执法权是政府运用行政权实现社会治理目标的核心权力,有效监督行政执法权,保证行政执法权的正确行使,对达到行政管理的预期目的至关重要。人民检察院作为宪法规定的专门法律监督机关,在法律地位上独立于政府,使其能从外部有效监督行政执法权,督促和推进行政执法权在法治轨道上运行,促进国家治理体系和治理能力的现代化。
