公平正义是社会主义法治理念的重要内容之一,是社会主义法治的价值追求。它要求社会成员能够按照法律规定的方式公平地实现权利和承担义务,并受到同等的法律保护。公平正义的理念一方面要求人们在法律面前或诉讼中的地位平等,另一方面要求居间者的不偏不倚、公而无私;一方面要求实体正义和实质正义,另一方面要求程序正义和形式正义。它是实体与程序的统一。
