法理学研究的重要课题之一就是现代社会下的法治现代化。法治现代化下的公司法内部私权不断扩展,既展现出了法治现代化对公司法发展的影响,亦展现了私权在商事法律主体内部蓬勃发展的面孔。公司法内部私权不断扩展展现为三个方面,即,强调平等精神与主体意识,使商事私权主体不断扩大;自由精神的承认和权利意识的接受,使私权客体范围逐步扩展;社会责任精神的强化,使弱势群体的私权获得一定保护。
One of the important topics in jurisprudence research is the modernization of law in modern society. The continuous expansion of internal private rights in the company law under the rule of law not only shows the influence of the modernization of the law on the development of company law, but also shows the prosperous development of private rights in the body of commercial law. The continuous expansion of the internal private rights in the corporation law is manifested in three aspects: emphasis on the spirit of equality and the awareness of the subject so that the subject of commercial private rights is constantly expanding; recognition of the free spirit and the acceptance of the awareness of rights allow the scope of the subject of private rights to gradually expand; Strengthen the spirit, so that the vulnerable groups of private rights to obtain some protection.
