《行政许可法》第48条第2款明确了行政许可听证笔录在许可决定中的法律效力,确保了许可申请人、利害关系人在听证程序中行使的权利延续到许可决定的作出过程中,增强了行政相对人对许可决定的接受程度。但是,除此之外《行政许可法》并无确保听证笔录在许可决定中法律效力实现的其他规定。本文以对行政许可听证笔录作出规定的法规规章为研究对象,对法条规定进行实证分析,梳理我国行政许可听证笔录的立法现状后发现:关于行政许可听证笔录的规定集中在部门规章及地方政府规章中,效力层级低且有适用范围的限制;多数规定是对《行政许可法》中原则性规定的重申,没有形成统一完善的行政许可听证笔录制度。本文立足于如何形成一份规范的全面的行政许可听证笔录,如何确保许可决定确实是根据听证笔录作出的这两个基本问题,提出七点建议:(1)提升规范行政许可听证笔录的法律效力层级;(2)选任合格的听证笔录主导者,建立听证员资格制度;(3)规范行政许可听证笔录的制作;(4)建立规范的行政许可听证笔录保管制度;(5)明确“新证据”的处理方式;(6)规范听证报告提出建议的方式;(7)行政许可决定书中应详细说明决定的理由。

It finds out that the stipulations concerning the transcripts of administrative permission hearings focus on the departmental rules and regulations, Rules and regulations, the effectiveness of the low level and the scope of the restrictions; most of the provisions of the “Administrative Licensing Law” in the reiteration of the principle, did not form a unified hearing permit transcript system. This article bases itself on how to form a normative and comprehensive record of the administrative license hearing.
