通过探讨贸易与环境的关系、贸易政策与环境政策协调产生的冲突等问题,认为现行世贸组织体制中“环保例外权”的一般化和模糊性规定导致国际贸易中的环境壁垒呈愈演愈烈之势,这对自由贸易进程,特别是对发展中国家的出口贸易构成严峻挑战。我国唯有深入研究和重视这一问题,才能在世贸组织未来的环境进程谈判中把握主动。
By discussing the relationship between trade and environment and the conflicts arising from the harmonization of trade policies and environmental policies, the general and ambiguous provisions of “environmental exception rights” in the current WTO system lead to the trend of environmental barriers in international trade being intensified. This poses a serious challenge to the free trade process, especially to the developing countries’ export trade. Only by studying and attaching importance to this issue in depth can China take the initiative in the negotiation of the future environmental progress of the WTO.
