在实际的法律案件审理过程中,难免会出现定罪及量刑之间的矛盾,若不能正确有效的处理两者之间的关系,将会在很大程度上影响量刑中的公正性。而罪刑的法定原则是刑事立法以及刑事司法中始终贯穿的基本原则,因此量刑以及定罪也必须在该原则的指导下进行,而想要实现刑法的公正也就必须始终遵循罪刑法定的基本原则。本文将对量刑公正以及刑法目的解释两者的关系进行分析,以促进我国的刑事法治。
In the process of trial of actual legal cases, the contradiction between conviction and sentencing will inevitably occur. If the relationship between the two can not be correctly and effectively handled, the impartiality in sentencing will be greatly affected. However, the legal principle of crime and penalty is the basic principle that always runs through both criminal legislation and criminal justice. Therefore, sentencing and conviction must be conducted under the guidance of this principle. And if we want justice of criminal law, we must always follow the basic principle of legality. This article will analyze the relationship between sentencing fairness and the purpose of the criminal law to promote the criminal rule of law in our country.
