法律解释学的转向是指法律解释学应改变那种以法律文本为对象、以注解为方法的研究 ,转向对文本与事实的互动关系的研究。而实用法学的第三条道路就是要消解主、客观主义之间对立的紧张关系 ,加强法律方法论的研究 ,尤其是对法律解释学的研究。我们应清楚法律并不仅仅是一般的行为规范 ,它最重要的任务在于解决纠纷。解决纠纷的手段多种多样 ,但法学家向社会贡献的主要是法学理论和法律方法 ,尽管这一理论和方法并非万能。
The shift of legal hermeneutics refers to that legal hermeneutics should change the research that takes legal text as object, annotation as method, and the interactive relationship between text and fact. The third way of practical jurisprudence is to eliminate the antagonistic tension between the primary and the objectivism and to strengthen the study of legal methodology, especially the study of legal hermeneutics. We should make it clear that law is not just a general code of conduct. Its most important task is to resolve disputes. There are many ways to solve disputes, but the main contribution of jurists to society is legal theory and legal method, though this theory and method are not universal.
