世贸组织(WTO)的法律框架由两部分组成,即:一部分是其若干原则和条款;另一部分是其“例外”条款,而“例外”条款从文字上看,是“原则”规定的两倍以上。从内容上看,“原则中有例外,例外中有原则”。认真研究这些“例外”条款,是全面把握世贸组织原则及其各项协议内容的重要组成部分,对于运用世贸组织规则极为重要。我国现在虽然不是WTO的成员国,但加入WTO只是时间问题,研究这些例外条款,对我们按国际经济通行规则办事,结合我国的具体国情,运用这些条款是极为有意义的。
The WTO’s legal framework consists of two parts, namely: one is a number of its principles and terms; the other is its “exception” clause, and the “exceptional” clause is literally double that of the “principle”. the above. From the content point of view, there are “exceptions in the principle and principles in the exception.” Serious study of these “exceptional” clauses is an important part of comprehensively grasping the principles of the WTO and the contents of its various agreements. It is extremely important for the application of the WTO rules. Although China is not a member of the WTO, it is only a matter of time before joining the WTO. It is extremely meaningful to study these exception clauses and to use our rules in accordance with the international economic rules and regulations, and in light of our country’s specific national conditions.
