环境事务的决策需要公民的直接参与,使公共舆论或公共意见之社会性融入环境决策之政治性,因平衡多元利益而论断该立法或决策在程序上是具有相当程度的正当性。从商谈模式的视角出发,可将我国环境事务的公民参与分为正式的建制化的立法、决策程序性参与及非规范化的自由模式的程序性参与。现有的政治结构显然不能积极反映公民的环境价值期望,有必要在宪法位阶上明确参与权,培育具有公民资格的公众以及健全支持环境参与的制度。
The decision-making of environmental affairs requires the direct participation of citizens, the socialization of public opinion or public opinion into the political decision-making process, and the conclusion that such legislation or decision-making is fairly procedural due to the balance of multiple interests. From the perspective of negotiation mode, the citizen participation in environmental affairs in our country can be divided into the formal, formalized legislation, the procedural participation in decision-making and the procedural participation in the non-standardized free mode. The existing political structure obviously can not actively reflect the citizens’ expectations of the environmental value. It is necessary to clarify the right of participation on the constitutional level, to foster a citizen with citizenship and to have a sound system to support environmental participation.
