专利是科技成果的重要载体,专利运营是科技成果转化的重要形式,科研院所和高校因为本身不生产和销售产品,与企业通常运用专利进行防御和巩固市场地位不同,其专利运用的主要途径是专利许可、转让、作价投资等运营行为。科研院所和高校专利运营的效果,很大程度上影响了科技成果转化的效率。2015年8月29日,第十二届全国人大第十六次会议通过了新的《促进科技成果转化法》,这次修订案遵循的主要原则是充分反映实施创新驱动发展战略对科技成果转化的新要求。新的《促进科技成果转化法》
