文章通过反思芝加哥学派关于反垄断法的理论研究,尝试以维护市场竞争秩序为反垄断法的内核,并基于此建构以促进市场开放、保障企业自由和保护消费者福利为支撑的反垄断法的价值目标体系,从而避免反垄断法在实践中因价值目标之间的冲突而造成反垄断法价值目标的“弥散化”。
By reflecting on the theoretical researches of the Chicago School on antitrust law, the article attempts to maintain the order of the market competition as the kernel of the antitrust law and based on this construct the antitrust law that is supported by the promotion of market liberalization, the protection of corporate freedom and the protection of consumers’ welfare Value target system in order to avoid the “diffusion” of antitrust law’s value target caused by the antitrust law in practice due to the conflict between the value targets.
