我国社会主义建设正处在关键时期,在国家进行建设和改革的过程中侵吞、吞噬国有资产、危害社会公共利益的现象日益突出。但由于种种原因,无人起诉,人民法院无法作出审判。刑诉法第87条规定:“如果被告人的犯罪行为使国家财产集体财产遭受损失的,人民检察院在提起公诉的时候,可以提起附带民事诉讼”。
The socialist construction in our country is in a crucial period. It has become increasingly prominent in the process of state construction and reform that it embezzles and engulfs state-owned assets and endangers the interests of the public in society. However, for various reasons, no one sued, people’s court can not make a trial. Article 87 of the Criminal Procedure Law stipulates: “If the defendant’s criminal activities result in the loss of the state property’s collective property, the people’s procuratorate may bring an incidental civil lawsuit at the time of prosecution.”
