合同附随义务自确立至今,经过不断的发展现已成为合同法中的重要内容之一。我国司法实践中对附随义务的适用还处于探索阶段,文章通过对现阶段附随义务制度的缺陷的分析,提出笔者对完善附随义务制度的拙见。
The contract accompanying obligation has been one of the important contents in contract law after continuous development since its establishment. The application of the incidental obligation in judicial practice of our country is still at the exploratory stage. Through the analysis of the defects of the incidental obligation system at the present stage, the article puts forward my humble opinion on improving the incidental obligation system.
