基于看守所准中立性的要求、各种主体之于诉讼行为适法性的要求和实现刑事诉讼目的的需要,有必要确定终止提讯/会见制度。看守所终止提讯的行为包括侦控机关在看守所中刑讯逼供或者变相刑讯逼供的行为、侦控机关手续不全和时间记载晚于提押出所时间的提押出所行为;看守所终止会见的行为包括辩护律师等增加看守所管理风险的行为、会见时从事非法活动的行为、携带家属/与案件办理无关的人会见的行为。对终止提讯/会见的行为,看守所应当进行证据保全以备查询和取证。看守所终止提讯/会见制度应当由最高立法机关通过立法的方式确定,以便于通过普适性规范调整终止提讯/会见行为。
