第一屆全国人民代表大會法案委員會聽了國務院副總理兼國防部長彭德懷向第一屆全國人民代表大會第二次會議所作的關於中華人民共和國兵役法草案的報告以后,於七月二十八日召開擴大會議,審查了中華人民共和國兵役法(草案)。一致認為中華人民共和國兵役法(草案)符合中華人民共和國憲法的精神,符合國防建設的需要和全国人民的要求。除將草案第十八條「由國務院規定」修正为「由國務院根據國家需要和各地情况規定」外,其餘各條完全同意原案。建議大會採納上述修正意見,全案予以通过。
After hearing the report of the deputy councilor and secretary of defense Peng Dehuai on the draft of the Military Service Law of the People’s Republic of China made by the second session of the First National People’s Congress, the Bills Committee of the First National People’s Congress convened on July 28 Enlarged the meeting and examined the Military Service Law of the People’s Republic of China (Draft). They all agreed that the draft military service law of the People’s Republic of China conforms to the spirit of the Constitution of the People’s Republic of China, meets the needs of national defense construction and the demands of the people throughout the country. Except for the amendment of Article 18 of the draft “as prescribed by the State Council” to “the provisions of the State Council in accordance with the needs of the country and the conditions in various places”, all other articles completely agree with the original case. It is recommended that the General Assembly adopt the above amendments and that the whole case be passed.
