当前,徇私枉法、以罚代刑等违法行政行为现象较重,落实和加强检察监督,规范行政执法行为是构建有中国国特色社会义义法治国家的重要内容。由于行政执法检察监督在法律和司法实践中存在不足,导致虽有法可依,但是实施结果不如人愿。为此,加快修订法律法规,制定配套措施,明确检察监督之强制性,规范检察监督之途径和方式,不断推进和完善行政执法检察监督机制。
At present, the phenomenon of overriding the crime of favoritism and committing acts of falsifying the law and committing excessive acts of law, and the implementation and strengthening of procuratorial supervision, and the standardization of administrative law enforcement acts are the important contents for building a country ruled by law with the socialism with Chinese characteristics. Due to the lack of legal and judicial practice in procuratorial supervision of administrative law enforcement, although the law can be followed, the implementation result is not as good as the wish. To this end, we will speed up the revision of laws and regulations, formulate supporting measures, clarify the compulsory procuratorial supervision and standardize the ways and means of procuratorial supervision, and constantly promote and improve the procuratorial and supervisory mechanisms for administrative law enforcement.
