在“接近正义”第三波浪潮的推动下,加纳引进了现代ADR机制,颁布了《ADR法》,对传统调解制度做了较大幅度的改进。考察新制度的运行成效,我们可以发现非洲传统观念和西方ADR价值之间存在一定的紧张关系,导致人们不愿选择利用调解来解决纠纷。加纳发展调解制度的经验表明,只有在尊重当地习惯和经验的基础之上,结合现代ADR的先进理念和规则,才能促进民众实质性地“接近正义”。
Driven by the third wave of “Close to Justice,” Ghana introduced the modern ADR mechanism, promulgated the “ADR Law,” and greatly improved the traditional mediation system. Examining the operational effectiveness of the new system, we can find that there is a certain tension between the traditional values in Africa and the value of Western ADRs, leading people not to choose to use mediation to resolve the disputes. The experience of Ghana in developing the mediation system shows that only by respecting local customs and experiences and by combining the advanced concepts and rules of modern ADR can the people be encouraged to substantially “approach justice”.
