知识经济的发展和网络技术的应用,改变了知识产权的生存环境,放大了知识产权的制度风险。文章认为在风险社会的知识产权的研究中,制度风险及风险控制是核心,新时期知识产权制度风险的法学治理:首先要从价值理性与工具理性相统一的视角切入;其次要从权力观念与责任观念相统一的角度出发;最后要从法律控制与技术规制相统一的准则去探索。
