我国现行刑法基本编就了惩治生态犯罪的刑事法网,但仍然存在一些明显的不足,刑事司法的现状也不尽如人意,对生态犯罪的刑事打击力度仍然不够。与其说生态犯罪的刑事政策是在经济发展与生态环境保护之间的选择,不如说它是在人类社会的短期利益与长远发展之间的选择。针对我国目前生态环境不断恶化、形势已然很严峻的状况,我国对于生态犯罪应当采取从严治理的刑事政策,生态犯罪的刑事立法与刑事司法都需要进一步完善。
However, there are still some obvious shortcomings. The status quo of criminal justice is also unsatisfactory. The criminal crackdown on ecological crime is still not enough. Instead of the criminal policy of ecological crime is the choice between economic development and ecological and environmental protection, rather than it is the choice between the short-term interests of human society and long-term development. In view of the current deteriorating ecological environment in China, the situation is already very harsh. Our country should take a criminal policy of strict control over ecological crimes. Both the criminal legislation and the criminal justice of ecological crimes need to be further improved.
