在“大众创新,大众创业”的背景下,众筹这一概念在中国被创造性地运用到商业运作上。在梳理国内、外相关文献的基础上,本研究提出了中国股权众筹发展中存在的四个劳动关系问题:众筹企业的股东是否是员工?控股的员工的薪酬应如何分配?持股员工的权利应如何保障?员工持股对企业的发展有什么影响?针对这四个问题,本文梳理美国及其他国家有关员工持股和员工控股企业的相关研究成果,探讨其对中国股权众筹发展实践的启示。
In the context of “mass innovation, mass entrepreneurship,” the concept of crowdfunding has been creatively applied to commercial operations in China. Based on the review of domestic and foreign literature, this study proposes four labor relations problems in the development of crowdfunding in China: whether the shareholders of crowdfunding companies are employees or not? How should the remuneration of holding employees be distributed? How to protect the rights of employee stock ownership on the development of enterprises have any impact on these four issues, this article combs the United States and other countries related to employee-owned and employee-controlled enterprises research results to explore its development of China’s equity crowdfunding Practical Enlightenment.
