在经历了“调解为主”、“着重调解”以及诉讼调解被质疑和否定之后,基于对“诉讼爆炸”的隐忧、法院案多人少和“案结事不了”的现状以及世界ADR运动的勃兴,诉讼调解重新回到人们的视野之中。本文意图澄清一些对诉讼调解的怀疑思想,强调诉讼调解是一种非对抗式的诉讼;诉讼调解并非反法治,而是平衡双方利益、检验司法水平和实现程序正义和实体正义的有效途径。
After experiencing “mediation-based ”, “focus on mediation ” and litigation mediation was questioned and denied, based on the “litigation explosion ”The status quo and the world ADR campaign boom, litigation mediation back to people’s perspective. This article intends to clarify some doubts about the mediation of litigation and emphasizes that litigation mediation is a non-adversarial litigation. Litigation mediation is not an anti-legal one, but an effective way to balance the interests of both parties, test the judicial level, and achieve procedural justice and substantive justice.
