两岸互涉交通事故人身损害常见情形有参加旅行社组织的旅游期间发生交通事故遭受损害、个人单独旅行乘坐公共交通工具发生交通事故遭受损害、个人步行或是使用自己的交通工具发生交通事故遭受损害,涉及的法律关系包括旅行者与肇事者之间的侵权法律关系、旅行者与保险公司之间的保险合同法律关系、旅行者与公共交通工具运营人之间的运输合同或侵权法律关系、旅行者与组团社之间的旅游合同法律关系、旅行者与地接社之间的代理服务法律关系。在对岸遭遇交通事故人身损害而寻求救济时,将面临案件管辖法院和赔偿义务主体的“选择”、人身损害赔偿标准的确定、判决的承认与执行等问题。
