在未成年人犯罪案件批捕阶段推行刑事和解制度,可以避免未成年犯因羁押引起的“交叉感染”和心理伤害,同时可以最大限度实现对受害权益的救济。但该机制在实际运行中存在着一些困难和问题,应该扩大适用范围、明确适用条件、完善制度措施,以发挥刑事和解机制的效用。
The implementation of the criminal reconciliation system in the process of arresting juvenile delinquency cases can prevent juvenile offenders from being “cross-infected” and psychologically injured as a result of detention, and at the same time, can provide relief to victims’ rights to the maximum extent possible. However, there are some difficulties and problems in the actual operation of the mechanism. The scope of application should be expanded, the conditions for application should be clearly defined, and the institutional measures should be perfected in order to give full play to the effectiveness of the criminal reconciliation mechanism.
