一、我国涉外专利状况及对比分析自从1985年我国《专利法》实施12年来,已取得了令世人瞩目的成就。国外发明者向我国申请并获取专利的国家和地区累计已达40多个。表1是自1985年4月1日至1995年12月31日的国外专利申请及专利授权情况统计。不难看出,外国发明人在我国申请最多的是发明专利,占总数的85.5％,实用新型所占比例最小,仅为2.7％。原因是其技术含量较低,有的国家不授予专利,外国发
