如何限制死刑,从而真正有效地发挥刑法的保障法益机能和保护人权技能,在刑事司法实践中无论从正反两个方面都具有莫大的现实意义和示范效应。废除死刑的道路很漫长,应当全方位的采取措施来限制、减少死刑的适用。这些措施包括在立法上缩小死刑的适用范围、明确死刑的适用标准、死刑的适用程序更加妥当化等等。
How to limit the death penalty, so as to effectively exert the law benefit function and the human rights protection skill of the criminal law, have great practical significance and model effect in both the positive and the negative aspects in criminal justice practice. The road to abolishing the death penalty is very long. Measures should be taken to limit and reduce the application of the death penalty. These measures include narrowing down the scope of the death penalty legislation, defining the applicable standards of death penalty, and more appropriate procedures for the death penalty.
