传统的监禁刑由于具有一定的局限性,已经不能很好地适应当前社会的犯罪情势,通过刑罚执行来对犯罪行为所起到威慑与预防作用已经逐渐弱化。因此,为了使监禁刑发挥社会管理作用,迫切地需要监外执行——即社会化的矫正措施来弥补监禁刑的劣势。文章认为,通过矫正社会化的实现,可以优化刑罚执行体系结构,调节司法资源配置,提高刑罚处罚与矫正的执行效率,同时还可以有针对性地面对各类犯罪群体进行矫正,以达到教育矫正效果。
Because of its limitation, the traditional imprisonment punishment can not adapt well to the crime situation in the current society. The deterrent and prevention of criminality through penalty execution has gradually weakened. Therefore, in order to make the imprisonment punishment play a social management role, there is an urgent need for extra-judicial enforcement, that is, socialized corrective measures to make up for the disadvantages of imprisonment. The article thinks that through the realization of corrective socialization, the system of penalty execution can be optimized, the allocation of judicial resources can be adjusted, the penalty punishment and the efficiency of correction can be improved, and at the same time, various criminal groups can be corrected in a targeted manner to achieve education Correction effect.
