劳动教养制度在我国已存在几十年 ,它在各个历史时期都发挥了很大的作用。但在十分强调依法治国的今天 ,我国的劳动教养制度确实存在不少缺陷。表现在 :一、劳动教养的性质模糊不清。二、劳动教养在实践中难以操作。三、劳动教养的适用对象过于狭窄。四、劳动教养适用的标准不统一。五、劳动教养期限设置不尽合理。六、劳动教养审批程序过于复杂。可从对劳动教养的性质定位、取消地域限制、确定适用对象、调整期限、简化审批程序、取消劳动教养管理委员会机构等六个方面对我国的劳动教养制度进行改进与完善。
The system of re-education through labor has existed in our country for several decades and has played a significant role in various historical periods. However, when stressing the importance of governing the country according to law, there are indeed many shortcomings in our country’s system of re-education through labor. Reflected in: First, the nature of reeducation through labor is vague. Second, reeducation through labor is difficult to operate in practice. Third, the object of reeducation through labor is too narrow. Fourth, the standard of reeducation through labor is not uniform. Fifth, the period of reeducation through labor setting is not reasonable. Sixth, the re-education through labor procedure is too complicated. The system of reeducation through labor in our country can be improved and perfected from six aspects: the orientation of reeducation through labor, the elimination of geographical restrictions, the definition of suitable objects, the adjustment of deadlines, the simplification of examination and approval procedures, the abolition of institutions for reeducation through labor and so forth.
