在读了格致出版社和上海人民出版社出版的由曾坚主编的《行政法与行政诉讼法》后,第十二章中有关国家赔偿的内容让我深有感触,国家赔偿作为一种国家责任,让我不由地联想到了新的国家赔偿法中的一些新亮点,进而想到了催生了行政赔偿和行政诉讼法的著名的中国首例“民告官”的包郑照案和近日备受关注的江苏海门市居民姚玉兰状告该市人社局“行政不作为”的行政复议案件,并由此对行政诉讼法进行了一些简单的阐述。
After reading the Administrative Law and Administrative Procedure Law edited by Zeng Jian published by Georgia Publishing House and Shanghai People’s Publishing House, the content of state compensation in Chapter XII gives me a deep feeling. State compensation is regarded as a national responsibility , I can not help but think of some new bright spots in the new state compensation law, and then I came up with the famous first case of “civil sue” in China that has given rise to administrative compensation and administrative procedural law. Concerned about the city of Haimen, Jiangsu Yao Yulan sued the city people’s Social Council “Administrative omission ” administrative reconsideration cases, and thus some simple exposition of the Administrative Procedure Law.
