法律论证是当代法学的一个热点问题,许多思想家提出了不同的法律论证理论,卢曼从其系统论的独特视角,对法律论证提出了独特的阐述,形成了独特的法律论证理论;文章结合了国外一些研究者的分析和作者个人的认识,从三大方面梳理了卢曼的有关观点,可丰富和拓展我们对法律论证及其理论的认识。
Legal argumentation is a hot issue in contemporary jurisprudence. Many thinkers put forward different theories of legal argumentation. From the unique perspective of system theory, Luhmann proposed a unique exposition of legal argumentation and formed a unique theory of legal argumentation. The analysis of some foreign researchers and the author’s personal cognition, combing the relevant points of Lu Man from three aspects can enrich and expand our understanding of legal argumentation and its theory.
