日本作为法史学研究较发达的国家,其法史学研究方法自有其独到之处。本文通过对日本法史学者著作的分析,勾勒出日本的中国法史学学科研究方法,从中解析出日本法史学所具有的包括重视考证的“静态”与注重法律实际运作的“动态”的以及比较分析等研究方法。近代中国法史学也是在传统的基础上引用西方的法律的概念和体系重构的,通过与中国近当代法史学研究方法的比较分析,从中得出日本法史学研究方法的可资借鉴之处。
As a country with more developed history of law and history, Japan has its own uniqueness in the research methods of law and history. By analyzing the works of Japanese law historians and scholars, this paper sketches out the research methods of Japanese law history in Japan, and analyzes the “static” features of Japanese law historiography which focus on textual research and the “dynamic ”As well as comparative analysis and other research methods. Modern China’s jurisprudence also refers to the concept and system reconstruction of western law on the basis of tradition. By comparative analysis with the research methods of Chinese modern and contemporary law history, it draws lessons to be drawn from the research methods of Japanese legal historiography.
