毛里求斯是非洲东部的岛国,曾是法、英两国的殖民地。其法律制度深受法、英两国法律模式的影响。毛里求斯宪法自1968年颁布以来,已历时46年。其宪法为成文宪法,内容体现英、法特色。毛里求斯宪政发展的内容具体表现为保障国家政权独立、个人基本权利及自由,实行议会共和制及立法、行政、司法三权分立,总统为国家元首,总统和内阁相互制约。毛里求斯宪政发展给予我国的启示是,必须确保宪法的最高法律地位;宪法之治的目的在于保障国家和人民的主权完整;人民的基本权利和自由的保障是宪法之治的内核,二者缺一不可。
Mauritius is an island nation in eastern Africa, once a French and British colony. Its legal system is deeply influenced by the legal model of France and Britain. The Constitution of Mauritius has been in existence for 46 years since its promulgation in 1968. Its constitution is a written constitution, the content reflects the English and French characteristics. The constitutional development of Mauritius includes the following contents: safeguarding the independence of the state power and basic personal rights and freedoms; implementing the parliamentary republicanism and the separation of the legislative, executive and judicial powers from each other; and the president restricts the heads of state, the president and the cabinet to each other. The enlightenment given to our country by constitutional development in Mauritius is that we must ensure the supreme legal status of the Constitution. The purpose of the constitutional rule is to guarantee the sovereignty and integrity of the country and the people.
