公安机关在打击犯罪、治安管理、社区防范、行政服务等方面,都发挥着重要作用,但是长期存在的“重实体轻程序”思想,严重影响了公安机关的执法规范化。本文试图通过对法治和程序的探究,结合公安工作实际,分析存在的突出问题,探究如何构建科学合理的程序法治体系,实现政治效果、法律效果和社会效果的有机统一。
The public security organs play an important role in the fight against crime, public security management, community prevention and administrative services. However, the long-standing thinking on “heavy procedures and light procedures” has seriously affected the law enforcement of public security organs. This article attempts to probe into the outstanding problems existing in public security work by exploring the rule of law and the procedure, and exploring how to construct a scientific and rational procedural rule of law system so as to realize the organic unity of political effect, legal effect and social effect.
