IPTV是一种新的三网融合传播技术,其架构主要分为内容运营平台和媒体传输平台,二者通过对接实现IPTV传输功能。对于具体的IPTV经营业务来说,如存在两个以上的经营主体,比如由其中一方负责内容运营平台业务,具体表现为IPTV节目内容的搜集,并存储于其服务器上;而由另一方负责媒体传输平台业务,具体表现为IPTV业务的传输技术支持,并直接与用户签订IPTV合同和向用户收取IPTV使用费。此时,两个经营主体对于IPTV业务有明确的分工,并共同分配由此带来的收益。本着权利、责任统一原则,如IPTV未经许可向用户提供他人享有著作权的作品,则两个经营主体应承担共同侵权的法律责任。
