本文从语篇范围、语篇基调与语篇方式上,研究最近十年香港雇员补偿判决书的正式度、典雅度及语用问题。首先,语料分析显示,香港判决书的语体正式度很高。因为判决书的型—例比率(type-token ratio)很高,判决书中第一人称代词的词次很低,第二人称代词与第三人称代词的比例很高,而香港法官自称的“本庭”“本席”等代替了第一人称代词。法官自称显示语篇基调中人际功能上法官的地位十分崇高,彰显了判决书在语篇功能上的强大约束力量;其二,从文白词语使用的对比词次,说明判决书的典雅度;其三,香港判决书的方言词与语法问题,说明香港判决书的写作水平有待提高。
This essay examines the formality, elegance and pragmatics of employees’ compensation awards in Hong Kong in the recent decade from the perspective of discourse scope, discourse style and discourse style. First of all, corpus analysis shows that the verdict in Hong Kong is very formalistic. Because of the high type-token ratio of the verdict, the first person pronouns in the judgments have a very low percentage of words, the second person pronouns have a high proportion of third-person pronouns, and the Hong Kong judge’s self-proclaimed “” court “ ”I " and so on instead of the first person pronoun. The judge claimed to show that the position of the judge on interpersonal functions in the tone of the discourse is very high and highlights the strong binding power of the verdict on the function of the discourse. Secondly, the article compares the verbatim use of the wording of the article to show the elegance of the verdict; The dialect words and grammar of the Hong Kong verdict indicate that the writing level of Hong Kong verdict needs to be improved.
