动产抵押制度是为适应资金融通以及动产用益的需求,并保障动产交易安全而创设的法律制度。它能使债务人继续占有使用动产而获得收益,同时又能使债务人获得充足的资金来清偿债务,克服了动产质押的缺陷,在我国具有重要的现实意义。然而我国现行动产抵押制度无论在理论上还是在实践上都尚存不足,仍需加以完善。本文结合欧美等国家和地区的一些立法经验,探讨我国动产抵押的公示以及动产抵押竞存权利间的优先顺位等方面存在的不足问题。
The movable property mortgage system is a legal system created to meet the needs of financial facilities and personal benefits, and to ensure the safety of movable property transactions. It can enable the debtor to continue to possess the proceeds from the use of movable property and meanwhile enable the debtor to obtain sufficient funds to pay off the debts and overcome the defects of movability of pledges, which is of great practical significance in our country. However, the existing movable property mortgage system in our country still needs to be improved in theory and in practice. This article combines some legislative experiences in Europe and the United States and other countries and regions to discuss the shortcomings in the publicity of China’s real estate mortgages and the priority among the rights of the real estate mortgages.
