我国学者对诱惑侦查是否具备法理正当性进行了长期的论争与探讨,各派学者从不同的价值立场出发,分别论证了诱惑侦查的法理正当性和弊端性。要认同诱惑侦查的正当地位,必须进一步追问其正当化的法理基础。
Scholars in our country have conducted long-term controversy and discussion on the legitimacy of temptation investigation. The scholars from all walks of life set out from different value standpoints to prove the legitimacy and malpractice of temptation investigation respectively. To recognize the legitimate status of temptation investigation, we must further investigate its legal basis for justification.
