随着现代科学技术的发展,传统知识的价值越来越为人们所认识并得到广泛利用,传统知识的国际保护成为国际社会关注的热点问题。由于传统知识本身所具有的特殊性,单纯依靠知识产权制度对传统知识进行保护在理论和实践上都存在一定的困难。因此我们有必要在研究传统知识现有的国际保护方式的同时探索其他的法律保护形式,并结合我国对传统知识保护的现状,做出有利于我国传统知识保护的利益最大化的选择。
With the development of modern science and technology, the value of traditional knowledge is becoming more and more widely known and widely used. The international protection of traditional knowledge has become a hot issue for the international community. Due to the particularity of traditional knowledge itself, the protection of traditional knowledge by relying solely on the system of intellectual property has some difficulties both in theory and in practice. Therefore, it is necessary for us to explore other forms of legal protection while studying the existing methods of international protection of traditional knowledge. In combination with the current situation of the protection of traditional knowledge in our country, we should make the choice of maximizing the benefits for the protection of our traditional knowledge.
