甘肃省是农业大省,但其农业生态环境却因为地理和气候等原因而极度脆弱,这也导致了环境问题成为制约甘肃可持续发展的一个重要因素。目前,我省的生物多样性从种类到数量等都在全国占有较为重要的作用。但是由于保护过程中存在的诸如资金划拨、制度构建等问题,以及对自然保护区的建设与景区建设之间存在的矛盾等问题,甘肃省对生物多样性的保护形势严峻。从生态环境补偿方面探讨甘肃省的生物多样性现状及法律制度构建的缺失,探讨生物多样性生态补偿法律制度构建良策。
Gansu is a major agricultural province, but its agro-ecological environment is extremely vulnerable because of its geographical and climatic conditions. This has also led to environmental problems becoming an important factor restricting the sustainable development of Gansu. At present, the biodiversity of our province occupies a more important role in the whole country, from species to quantity. However, due to such problems as the transfer of funds, system construction and other problems existing in the protection process, such as the contradiction between the construction of nature reserves and the construction of scenic areas, the protection of biodiversity in Gansu Province is in a serious situation. From the aspects of ecological compensation, this paper discusses the current situation of biodiversity in Gansu Province and the lack of construction of legal system, and discusses the best ways to construct a legal system of ecological compensation for biodiversity.
