案情回顾2011年5月,G招标公司受Q市卫生局委托,就Q市医疗卫生单位一次性使用无菌注射器等医用耗材项目组织公开招标协议采购。经过既定的招标程序,得出了招标结果并进行公示。结果公示期间,投标人L器械公司向G招标公司提出质疑,认为此次招标过程存在违法操作,结果应为无效。G招标公司在规定的时间内对质疑进行了回复,但L器械公司对回复内容不满,于是向当地政府采购监管部门(下称监管部门)提出投诉。
Case Review May 2011, G bidding company commissioned by the Q City Health Bureau, Q City, medical and health units one-time use of sterile syringes and other medical consumables project public bidding agreement procurement. After the established bidding process, the tender results obtained and publicized. During the public announcement of the results, Bidder L Instruments challenged the bidding company G to believe that there was an illegal operation during the bidding process and the result should be invalid. G bidding company responded to the challenge within the stipulated time, but L instrument company was dissatisfied with the content of the reply, so it filed a complaint with the local government procurement supervisory department (hereinafter referred to as supervisory department).
