法学本科教育误入“以司法考试为导向”之歧途虽有其特殊背景,但法学本科教育以司法考试为导向的观点与做法是错误的,如以司法考试为导向,势必降低法学本科教育的整体层次,影响学生法学知识框架的构建以及综合素质的提高,致使其法学知识缺失、基本功不扎实、法学逻辑思维不严谨,将使法学本科教育重蹈中国应试教育的覆辙。因此,应该在法学本科教育基础上改革与完善我国司法考试制度,在司法考试背景下改革与完善我国法学本科教育,使二者良性互动发展,相得益彰。
Despite its special background, the undergraduate education of law is misjudged into the “misjudgment of judicial examination”. However, the view and practice of law undergraduate education directed by the judicial examination are wrong. Under the guidance of judicial examination, it is bound to reduce the number of undergraduates The overall level of education affects the construction of students’ jurisprudence knowledge framework and the improvement of its overall quality, which results in the lack of legal knowledge, lack of solid basic skills and unscrupulous legal logic. It will make law undergraduate education repeat the mistakes of Chinese examination-oriented education. Therefore, we should reform and improve our judicial examination system on the basis of law undergraduate education, reform and perfect our legal science undergraduate education under the background of judicial examination, so that the two can play a positive role in each other’s development.
